Games Almanac Terms of Service

1. Definitions

"Games Almanac," "the App," "we," "us," or "our" refers to Daniel Bernardi, located in Vancouver, Washington. "You" or "your" refers to the user of the App.

2. Acceptance of Terms

By downloading, accessing, or using Games Almanac, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

For features requiring an account, you must explicitly accept these Terms before creating your account.

3. Description of Service

Games Almanac is a mobile application that provides video game release tracking, including:

  • Browsing upcoming and past game releases
  • Saving favorite games for personalized tracking
  • Receiving push notifications about game releases and updates
  • Viewing game details, ratings, and platform availability
  • Syncing data across devices (with an account)

The App is currently offered free of charge with no ads.

4. Eligibility

The App is intended for users aged 13 and older. By using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

5. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes, subject to these Terms.

You may not:

  • Copy, modify, or distribute the App
  • Sublicense, sell, or transfer the App to any third party
  • Use the App to build a competing product or service
  • Remove any proprietary notices from the App

This license terminates automatically if you violate these Terms.

6. User Accounts

6.1 Account Creation

You may use certain features without an account. To access features like cloud sync and push notifications, you must create an account using a supported authentication provider (e.g., Apple, Google).

6.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

6.3 Account Termination

You may delete your account at any time through the App settings. We may also terminate accounts that violate these Terms.

7. User Content and Data

7.1 Your Content

You retain ownership of any content you submit to the App, including your favorites lists and preferences.

7.2 License to Us

By using the App, you grant us a limited, worldwide, royalty-free license to use, store, and process your content solely to operate and improve the App.

7.3 Data Portability

You may export your data through available App features or by contacting us.

8. Optional Support (Tip Jar)

8.1 Voluntary Contributions

Games Almanac offers an optional tip jar for users who wish to support the App's development. Tips are entirely voluntary and do not unlock any additional features or content.

8.2 Tip Options

Tip amounts are displayed in the App and may change from time to time.

8.3 Payment Processing

Tips are processed through the Apple App Store or Google Play Store. All transactions are subject to the respective platform's terms and refund policies.

8.4 No Obligation

You are under no obligation to tip. The App's full functionality is available to all users regardless of whether they choose to support development.

9. Prohibited Conduct

You agree not to:

9.1 Unauthorized Access & Interference

  • Attempt to gain unauthorized access to the App, its servers, or related systems
  • Interfere with or disrupt the App's functionality or infrastructure
  • Bypass, disable, or circumvent any security features
  • Introduce viruses, malware, or other harmful code

9.2 Data Collection & Scraping

  • Scrape, crawl, or harvest data from the App through automated means
  • Use bots, scripts, or automated tools to access or interact with the App
  • Collect, store, or share user data obtained from the App
  • Reproduce, republish, or redistribute game data from the App for commercial purposes
  • Create derivative databases from the App's content

9.3 Misuse

  • Use the App for any unlawful purpose
  • Impersonate any person or entity
  • Reverse engineer, decompile, or disassemble the App
  • Resell, sublicense, or commercially exploit the App
  • Use the App in any way that could damage, disable, or impair our services

9.4 Circumvention

  • Manipulate the App to receive notifications for games you have not favorited
  • Create multiple accounts to circumvent any usage tracking
  • Exploit bugs or vulnerabilities rather than reporting them

10. Intellectual Property

10.1 App Content

The App, including its design, features, code, and original content, is owned by Games Almanac and protected by intellectual property laws.

10.2 Game Data

All game information, including titles, descriptions, images, release dates, and ratings, is sourced from IGDB (https://www.igdb.com) and remains the property of their respective owners. Games Almanac does not claim ownership of this third-party content.

Games Almanac is not affiliated with, endorsed by, or sponsored by IGDB or Twitch Interactive, Inc.

10.3 Trademarks

Game titles, logos, cover art, and related marks are trademarks of their respective publishers and developers. Their use in the App is for informational purposes only.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS OF CONTENT, AND UNINTERRUPTED OR ERROR-FREE SERVICE. GAME RELEASE DATES, RATINGS, PLATFORMS, AND OTHER INFORMATION ARE PROVIDED BY THIRD-PARTY SOURCES AND MAY BE INACCURATE, INCOMPLETE, OR CHANGE WITHOUT NOTICE. WE DO NOT GUARANTEE THE ACCURACY OR TIMELINESS OF ANY GAME DATA. WHILE WE STRIVE TO DELIVER TIMELY NOTIFICATIONS, WE CANNOT GUARANTEE DELIVERY DUE TO DEVICE SETTINGS, NETWORK CONDITIONS, OPERATING SYSTEM LIMITATIONS, OR PLATFORM RESTRICTIONS. YOU SHOULD NOT RELY SOLELY ON THE APP FOR TIME-SENSITIVE INFORMATION. THE APP RELIES ON THIRD-PARTY SERVICES (IGDB, PUSH NOTIFICATION PROVIDERS, AUTHENTICATION PROVIDERS), AND WE ARE NOT RESPONSIBLE FOR THE AVAILABILITY OR ACCURACY OF THESE SERVICES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMES ALMANAC AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, MISSED GAME RELEASES OR INACCURATE RELEASE INFORMATION, UNDELIVERED OR DELAYED NOTIFICATIONS, LOSS OF DATA OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT, OR ANY OTHER MATTER RELATING TO THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN DOLLARS ($10.00).

14. Indemnification

You agree to indemnify, defend, and hold harmless Games Almanac and its developers from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the App, your violation of any third-party rights, or any content you submit to the App.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us. We will attempt to resolve the dispute within 30 days.

15.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the App that cannot be resolved informally shall be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall be conducted in Washington, unless otherwise required by applicable law, and may be conducted virtually. The arbitrator's decision shall be final and binding.

15.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15.4 Jury Trial Waiver

YOU WAIVE ANY RIGHT TO A JURY TRIAL IN ANY DISPUTE ARISING FROM THESE TERMS OR YOUR USE OF THE APP.

15.5 Small Claims Exception

Notwithstanding the above, either party may bring an individual claim in small claims court if the claim qualifies.

15.6 Injunctive Relief Exception

Either party may seek injunctive relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

16. Export Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

17. Apple App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that:

  • The App is licensed to you by Games Almanac, not Apple Inc. ("Apple")
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for the App or its content
  • In the event of any failure of the App to conform to applicable warranties, your sole remedy is a refund of the purchase price (if any) from Apple
  • Apple is not responsible for addressing any claims relating to the App
  • Apple is a third-party beneficiary of these Terms and may enforce them against you

18. Modifications

18.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.

18.2 Terms Changes

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be communicated through the App.

19. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we reasonably believe violates these Terms, is harmful to other users or the App, constitutes data scraping or automated access, or is fraudulent or illegal.

Upon termination, your license to use the App is revoked. We may retain certain information as required by law or for legitimate business purposes, such as to resolve disputes or enforce our Terms.

20. General Provisions

20.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles.

20.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Games Almanac regarding the App and supersede all prior agreements, understandings, and communications.

20.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

20.4 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

20.5 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.

20.6 Survival

The following sections survive termination of these Terms or your account: Intellectual Property (Section 10), Disclaimer of Warranties (Section 12), Limitation of Liability (Section 13), Indemnification (Section 14), Dispute Resolution and Arbitration (Section 15), and General Provisions (Section 20).
